Is "waterboarding" torture? A vexing debate has raged over the question for several years now, but here's an Associated Press report from Monday that ought to settle the question once and for all:

Anti-war protesters are hoping a demonstration of waterboarding will convince a Senate committee to reject Attorney General-nominee Michael Mukasey (myoo-KAY'-zee).

Mukasey has repeatedly refused to say whether he considers the interrogation technique that simulates drowning a form of torture.

About 25 protesters set up the demonstration outside the Justice Department's headquarters. They poured water over the face of a volunteer as he lay on his back; he was reduced to retching coughs and tears in less than four minutes.

By the time of this demonstration, Sens. Chuck Schumer and Dianne Feinstein had already announced their support for Mukasey, which means his confirmation was assured. It is preposterous to call this procedure "torture" when people are willing to undergo it merely in order to make a futile political gesture.

If firearms availability were the determining factor, Vermont and Switzerland would have high murder rates. Yet in Montpelier or Geneva the solution to a boy carelessly bicycling in front of you down a city street when you're in a hurry is not to grab your gun and blow him away. It's the culture, not the technology.

But notice the vertical bars at the right side of the graph, which show the "90 percent confidence interval" --- the chances that the graph line is actually where it is shown to be. Turns out that the orange confidence interval includes all the points on the graph between 1930 and 2000... meaning that we can't tell that any of those points are different from each other with even 90 percent certainty. And that's not even including the big Black Hole of water vapor.

Now "90 percent confidence" might sound like a lot. But in standard scientific publications a 95 percent confidence level is the minimum acceptable level. The reason is that one can just run a study 10 times, and achieve a 90 percent confidence level purely by chance. So we normally demand a higher standard of proof --- at least 95 percent confidence. The data in the SCIENCE graph therefore does not meet routine scientific standards............

If the court accepts Mr. Fitzgerald's logic, the sentence meted out in this fantastic case would at least double, to a minimum of 30 months. So it goes in a case brought by an unaccountable prosecutor now requesting an unreasonable penalty based on evidence he never introduced at trial. This is America?
Throughout Mr. Libby's prosecution, Mr. Fitzgerald insisted it made no difference to the case whether CIA officer Valerie Plame Wilson was undercover. At one pre-trial hearing, he went so far as to argue it would make no difference to the case "if [Ms. Wilson] turned out to be a postal driver mistaken for a CIA employee." He also objected to defense requests for documents concerning her status, insisting this was a perjury trial, not a trial about leaking classified information.

Considering man does not release into the atmosphere CO₂ and methane at the same rate and yet scientists find a near perfect correlation between CO₂ levels, methane levels, and global temperatures, maybe it is the Earth getting warmer, which causes the gas release from the oceans and not the other way around. Maybe this can all be explained by the sun going through a period of increased activity, generating more heat. And maybe that is why Mars is experiencing global warming too!.............

The Clinton legacy, already shredding because of his inability to deal with al Qaeda and terrorism, has just been dealt yet another -- perhaps mortal -- blow by Clinton and Carter's foolish trust in the North Korean father and son dictators. But more importantly, the problem now is that Democrats are running for House and Senate seats all over the nation supporting some version of this very same appeasement policy towards Iraq, the War on Terror, and critically, Iran.

But the hypocrisy comes in because the Democrats have as their dean in the Senate an actual former Klansman, Robert Byrd of West Virginia. In my very clear memory, the whole bulk of the senior Democrats routinely called blacks "nigras" and voted against any kind of civil rights laws, right down to anti-lynching laws. And this is the party that presumes to judge a man because he owns a Civil War artifact memorializing incredible American courage? Didn't we just recently have as President a Democrat from Georgia who was inches away from being a segregationist in his early career? And what did his state flag look like when he was governor? And George Allen is being judged by these people?

Again, for sheer hypocrisy, the winner is: the Democratic Party. Again.
